Website owner faces 40 prostitution charges in ABQ

A New Jersey professor was arrested in Albuquerque Sunday in connection with an online prostitution ring.

David Flory of New York City was charged with 40 counts of promoting prostitution and running the online prostitution website, Southwest Companions.

According to the criminal complaint the website is only accessible after submitting an application and then being approved by the webmaster.

There are three levels of membership based on references from providers (prostitutes) and/or members (male clients). The complaint lists approximately 1400 registered members and providers with access to the website.

Authorities were made aware of the website and after several months were able to gain access as “trusted” members. From there authorities were able to identify David8, later identified as Flory, as the owner and webmaster of the website which he used to operate a house of prostitution on the internet.

Flory also works as the Coordinator of the Physics Department at Fairleigh Dickinson University in Madison, New Jersey.

Officials believe Flory had homes in both New York City and Santa Fe and say he was taken into custody at a coffee shop in Albuquerque's Nob Hill area.

Investigators believe Flory had come to New Mexico on "website business."

A physiscs professor at Fairleigh Dickinson University, a prestigious East Coast school, was in jail in Albuquerque late Monday on charges that he was running a multi-state, Internet-based prostitution ring that had more than 1,400 registered members, according to court records.

David C. Flory, 68, faces 40 felony counts of promoting prostitution, according to a criminal complaint filed in Metropolitan Court.

He was jailed at the Metropolitan Detention Center — where he was being held on a $100,000 cash or surety bond — following his arrest in Albuquerque on Sunday evening, court and jail records state.

A months long APD Vice Unit investigation resulted in the arrests of several prostitutes who were working for Flory’s “Southwest Companions” Internet ring, according to the omplaint.

After confirming Flory’s identity, detectives traced him to a home he owns in Santa Fe last week, the complaint states. The detectives arrested him in Albuquerque on Sunday.

Albuquerque vice detectives say Flory is the creator of southwestcompanions.info, a members only online prostitution operation that connects prostitutes from the southwest with johns.

The website has several layers of protection designed to keep police out, but Albuquerque police say they were able to infiltrate it during a 6 month investigation with the help of prostitutes and johns they recently arrested.

"Its a big operation," said APD vice Lieutenant William Roseman. "It has 14-hundred members involving roughly 200 prostitutes and the other 1200 are male members seeking encounters." Investigators say through their investigation they learned that Flory was conducting most of the site's business out of his apartment in Manhattan, New York

"He was very surprised, most of all wondering how we knew where he was at," said Lt. Roseman.

Albuquerque police say New York and New Jersey police did conduct search warrants on his home in Manhattan and at his office in New Jersey. They are investigating whether Flory was running other prostitution sites out of those areas.

They say he also has a home in Florida and plan to reach out to authorities there.

APD says there are likely more arrests to come, but wouldn't elaborate on who they are looking at.

"There are several members we have identified and are tracking and they aren't aware we are aware of them and we will be knocking on their door shortly," Roseman said.

Flory’s website, Southwest Companions, had operated for months before several prostitutes in Albuquerque mentioned the site to police and they began investigating late last year, Roseman said.

Users were split into three categories, and first-time visitors had to first gain the trust of Flory before gaining any access. Ordinarily this was done, Roseman said, by “sleeping with a prostitute.” The prostitute would then report to Flory what sexual acts the two had engaged in, as well as how much money was exchanged.

After that process, users were designated as “Verified,” gaining access to a wider circle of women to choose from, Roseman said. If users became more frequent customers, their status was increased to “Trusted,” which gave them access to more women and more portions of the website, including message boards explaining how to avoid the police, Roseman said.

“They had descriptions of my officers, phone numbers they used, videos of an attorney telling them that if you get busted by the police, here’s what you should do,” Roseman said. “This was a website designed, managed, and run fully for prostitution.”
The site also included message boards where users could rate the prostitutes with stars, including the rating of specific sexual acts, Roseman said. Flory is alleged to be behind it all.

“Anybody who was approved for the website was approved by him,” Roseman said.

Flory also told police that he did not make money off of the website and instead saw it as a hobby, “a safe place for guys to find female prostitutes,” Roseman said.

A professor at the Madison campus of FDU, Flory holds a master’s degree from Columbia University and a Ph.D. from Yeshiva University, according to FDU’s website. In a statement, FDU spokeswoman Dina Schipper said that the university was “saddened” by the news.

“Our hearts go out to all of those impacted by the situation,” Schipper said. “Since becoming aware of the arrest, the University has cooperated with law enforcement authorities as they seek to gain the most accurate information as part of their ongoing investigation in New Mexico.”

"If one of my detectives set up a date with a prostitute they would try to run background checks on them before they would do the date," said Roseman.

Prostitutes worked with police and made sure Flory believed the agents were trustworthy clients.

After six months of undercover work investigators got to the trusted status and were able to access all the information on the site.

Then agents got a tip that Flory was headed to New Mexico on website business.

"We had enough information to do the arrest warrants and the search warrants and we knew he was going to be inside our jurisdiction so we began tracking him once he arrived in New Mexico and it just culminated on Sunday when he was having coffee at a Starbucks when the two detectives walked behind him," Roseman stated.

As police began to arrest him, they could see from his phone that he was logged online to his site Southwest Companions.

"He told us that he wanted a secure site for people to "hobby" that they did not have to worry about law enforcement. So he intentionally set this up as a site to have prostitution occur without the fear of law enforcement taking over," Roseman explained.

"Lustfull Samantha" cooperated by allowing detectives to look at emails sent to her through the website, where they found a message from "David8" — Flory's suspected online username — telling Samantha not to post advertisements that were so explicit and to use acronyms for sex acts.

The nicknames of more than 60 prostitutes, coded terms for sexual acts they offer to perform and their prices — ranging from $80 to $850 — are listed on the criminal complaint. It also gives the real names, addresses, dates of birth and Social Security numbers of about a dozen prostitutes. Most were from Albuquerque and two were from Colorado, but none were listed from Santa Fe or other New Mexico towns.

Albuquerque police have investigated other online prostitution networks using Craigslist and Backpage websites, Roseman said, but none as sophisticated as Southwest Companions, which has a three-stage hierarchical system of membership and admits new members only on the recommendation of other members.

Roseman said Flory has obtained legal counsel in Albuquerque, but the officer didn't know the lawyer's name. Flory's wife, Sharon, reached at their residence in New York City, declined comment. "I'm not interested in talking to you," she said.

About 45 minutes after Flory was taken into custody, police in New York and Teaneck executed search warrants at his home and FDU office to confiscate computer equipment. Authorities plan to send the equipment to an FBI computer forensic lab for review, Roseman said.

Police were tipped off to the existence of the website through prostitutes and johns who cooperated with investigators to avoid arrest, Roseman said. He said most of the site's users were from the Albuquerque area, though some were from Denver and Phoenix.

Police monitored the site for several months. The investigation led to the arrest of an unknown number of prostitutes, and authorities are reviewing Flory's computers to try to obtain the identity of other users of the site, Roseman said.

On May 31, police subpoenaed records from GoDaddy.com, which registered the domain for the website. A few weeks later, police learned that a David Flory of New York owned the website, according to the arrest warrant.

The former University of New Mexico President was arrested and jailed Thursday, June 23, 2011 in connection with a multistate, online prostitution ring that authorities say was run by a physics professor from New Jersey. Garcia was booked on a $35,000 cash or surety bond for investigation of promoting prostitution, tampering with evidence and conspiracy, Metropolitan Detention Center records

Among the site's top echelon was former University of New Mexico President F. Chris Garcia, who used the handle "Burque Pops" while acting as a moderator, police said.

Douglas Plummer, 40, who owns a landscaping company in Albuquerque, and Mike Dorsey, 36, who lives in New Mexico. Plummer and Dorsey both face charges of promoting prostitution and conspiracy.

Some men make model train sets as a hobby, some men take up golfing as a hobby. David Flory constructed and operated an entire prostitution website as a hobby under the premise that there just wasn’t enough safety in the prostitute system to date.

"This was about sex," Roseman said, noting that a lot of the clients had too much to lose to go looking for prostitutes on the street. "They needed a safe place where they could go to do this."

Authorities said the ring was based in the Albuquerque-Santa Fe area, but reached into Phoenix and Denver.

"There are probably some very nervous people out there right now," said Albuquerque Public Safety Director Darren White.

The operators also used the site to build a database of undercover police officers to help members recognize them and avoid arrest, police said.

Police said the site was started in 2005 by Cara Garrett, who first tipped off vice officers after she was arrested on drug, child abuse and prostitution charges in December. Garrett was arrested Wednesday in Roswell for investigation of threatening another informant in the case.

Police said she sold the site in 2007 to another suspect, Mike Dorsey. He then sold the site in 2009 to Flory, police said.

Two other men, Porter Smith and Douglas Plummer, also were arrested, and a warrant was issued for Virginia Harringer, of Santa Fe. It was not immediately known whether any of them had retained attorneys. Flory was released Wednesday after posting bond.

Garcia is a professor emeritus of political science at the University of New Mexico and served as its interim president from 2002 to 2003. A distinguished professor and well-known expert on New Mexico politics, Garcia served from 1987 to 1990 as vice president of academic affairs, a position now called provost. He was the dean of the College of Arts and Sciences from 1980 to 1986.

Garcia is also an author whose 11 books include "Hispanics and the US Political System" and "Moving into the Mainstream."

The university said Garcia has been temporarily suspended, and called his arrest "a severe blow." The school characterized the allegations as "shocking, distressing and deeply disturbing."

At the school Thursday, Garcia's office door was closed and locked. University officials said he had no summer classes scheduled.

"It kind of scares me because you have to trust these professors and then when they do this kind of thing, it's like, how can you trust anyone, especially someone who's in a higher power?" said Marie Gonzales, a recent high school graduate from Albuquerque who was visiting campus.

a 28-year-old New Mexico woman was arrested for attempting to bribe and intimidate a witness, also connected to the Southwest Companions case.

In addition to local law enforcement, the Secret Service is now involved due to a Colorado escort named Krispi Kreme, who could make this an interstate crime:

"We're looking at the interstate angle and potential wire fraud," said Special Agent Rich Ferretti. Police sources said Flory set up a site for, among others, "Krispi Kreme," a Colorado-based escort who promised to provide "a full girlfriend experience that will leave you breathless."

While Flory said it was a hobby, the Secret Service isn't so sure. Separate from the prostitution charges, the Secret Service is investigating whether or not Flory made money creating personal Web sites for escorts who used his site.

Ironically, his cohort Garcia had a great deal of esteem and a great deal to lose. A page devoted to him on Amazon.com lists a number of awards, including the New Mexico Governor's Distinguished Public Service Award, the Franklin J. Goodnow Award for Distinguished Service from the APSA, the Regents' Meritorious Service Award, the APSA/COSCP Recognition Award and the Navajo Nation's Chief Manuelito Award.

Key issues as I have preached for years and am doing some huge articles about on the Private List for tonight...

1) NEVER BREAK THE LAW, than you don't have to worry about the law. No money for sex. And no GFE or terms that are often related to sex in ads.

2) With the secret service involved in the SWC case they are clearly looking for any money trial between "prostitutes" and forum owners.''

But if your not offering sex for money you are not a "prostitute" or if your not offering money for sex you broke no law.

As folks know I have never received a dime for any companion ad and the Companion List is free to verified companions who offer their companionship for time not sex. Or massage gals that are LMTs and offer massage not sex for money.

In next List update also talk a lot about free speech issue related to reviews. But of course they should not suggest anything illegal for the safety of the companion, since she should not be offering anything sexual for money.

Or, better, how do I fix it?" he asked in his first post on a computer help forum. Helpful techies responded with several ideas. "I tried all three suggestions and none worked. Same error message," a frustrated Flory replied.

A month later, with cops breathing down his neck, the Fairleigh Dickinson prof of 42 years still couldn't delete the sleazy content and made a panicked cry for "help, please!" Authorities say Flory's business serviced as many as 200 hookers and 1,400 johns across the Southwest, and was based at his luxury adobe vacation home in Albuquerque. Using code, the women would advertise the sexual services they were willing to perform and how much they charged. And the johns -- who needed Flory's personal OK before they could join -- would be able to rate the call girls to give other clients inside information.

The prostitution ring, which is based in Albuquerque, also conducts operations in Colorado, Arizona, New York and New Jersey, according to Garcia’s arrest warrant.

APD discovered the prostitution ring in December 2007, and has been investigating since.

Garcia and other moderators are paid little, if anything, for their moderation duties.

UNM President David Schmidly said Thursday in a University-wide email that he was shocked to learn the news of the pending investigation, especially since Garcia has been affiliated with the University for 41 years and served as its president.

“This is just the beginning of this investigation; more arrests are possible.”

Detectives created false online usernames and used confidential informants to grant them access to the site. The site operates on a three-tiered hierarchy, and members have varying levels of access to the site depending on their status,

“Once in this verified status, you were required to spend some time with other women,” Roseman said. “An email would be sent to the moderator describing the act and amount paid, and the moderator would track it and when you reached a certain point, you would receive trusted status.”

Mr. Flory didn't really profit all that much from the website. He wanted to create a safe website to connect prostitutes and would be johns. Why was that kind of service needed? Well, because it is illegal. Because prostitution is illegal it then, like drugs, creates a black-market because there is high demand for those things.

Brothels that are legal in Nevada don't have the problems of underage girls. They don't have high rates of sexually transmitted diseases, as is common with street prostitution. They don't have violence committed against those women. Why? Because it is legal and regulated.

So the government spent half a year investigating this website. How many hundreds of thousands, if not millions, did this operation cost? How much will it cost to bring this man to trial? How much to imprison him? He was held at $100,000 bail, which is the level that many murder suspects get.

ALBUQUERQUE, N.M. — Albuquerque police found pornographic videos and sex toys in the University of New Mexico office of former UNM President F. Chris Garcia, who's charged with helping operate an online prostitution ring.

The Albuquerque Journal reports Friday that search warrant affidavits indicate police found Garcia's briefcase full of sex toys and a cabinet in his UNM office had more of them. Also seized were nine sex books, 21 sex videos and a folder with information on criminal laws about prostitution.

Police say Garcia's duties included recruiting women for the online prostitution service known as Southwest Companions, which allegedly was run by Fairleigh Dickinson University professor David Flory.

Garcia is a professor emeritus of political science and was interim UNM president from 2002 to 2003
